During Cuomo’s May 13th daily covid 19 press event New York Governor Andrew Cuomo claimed, “I did everything I could,” to protect residents of nursing homes, despite a major reversal on Sunday of his policy to force nursing homes to accept patients from hospitals who had covid 19 infections. More than 5400 New York nursing home residents have died so far, and that number does not include nursing home residents who were sent to hospitals where they died. According to the Associated Press, 40% of all nursing home deaths from covid 19 in the US have been in New York which has less than 6% of the total population.

Richard Gottfried (D-Manhattan), Chair of the Assembly Health Committee, among other legislators has called for an independent investigation of Cuomo’s nursing home policies.

Sen Patrick Gallivan (R- Western New York)) the ranking member of the Senate Health Committee, said, “The exact number of deaths caused by COVID-19 among nursing home residents is unclear, but some reports indicate they have made up roughly one-fourth to one-fifth of the state’s total fatalities,” Gallivan said. “Equally uncertain is the number of confirmed or presumed cases of the virus among residents and staff. This is unacceptable.”

Assemblymember Ron Kim, (D-Queens) said in a statement, “Our community continues to reel from anger and disbelief at the negligence and disregard shown on this issue, and the irreparable harm done to nursing home residents in our community, throughout New York.”

Former Governor George Pataki has called for an investigation as well, characterizing Cuomo’s handling of covid 19 in nursing homes as a “disaster.”

Assemblymember Nicole Malliotakis (R-Staten Island) has called for a federal investigation.

Another major question that must be investigated is the refusal of the state to allow nursing homes to send patients with covid 19 symptoms to hospitals for appropriate treatment. One of the worst hit nursing homes is the Cobble Hill Care Center in Brooklyn which has had at least 55 residents die. As early as April 9 administrators pleaded with state officials to allow patients suspected of having covid 19 to go to hospitals but were denied.

Remember the only reason New Yorkers lost their right to a religious exemption from vaccine mandates to attend school was because Cuomo decided it was politically advantageous for him to do so. Prior to his belated, but decisive, involvement in the effort to repeal the religious exemption last June, it was clear that there were not enough votes to pass the measure in the Assembly. Cuomo cut deals and twisted arms to make it happen and it did.

If you cannot get a medical exemption from a vaccine mandate to attend school for your child, Cuomo is responsible for that as well. He allowed practices to develop that made getting an exemption exceedingly difficult, and then had the state regulations re-written last summer to allow exemptions almost exclusively in situations when a child has already had a documented near-death, anaphylactic reaction to a previous shot. The need to prevent injury was completely discarded and replaced with a policy that only allows avoiding re-injury in very limited cases.

Cuomo Loses Big in Court!

It’s Not Over, but Medical Exemption to Vaccination Strengthened in NY

April 25, 2020 — 12-year-old autistic Thorn Schwarz was kicked out of school when Cuomo forced an “emergency regulation” in August of 2019 that illegally took away a valid medical exemption to vaccination Thorn had for years. Now not only has Thorn been allowed back into school permanently, judge Dan Doyle has reached a preliminary ruling that Governor Cuomo and the New York Department of Health have “over-stepped” their authority.

That’s real good!

It means we have come much closer to getting hundreds of disabled children back into school in New York with valid medical exemptions to vaccination! The case isn’t over, but it is moving in the right direction. This is a major blow for Governor Cuomo and his Commissioner of Health Howard Zucker.

Some good news. In a decision yesterday NY Supreme Court Judge Daniel Doyle allowed 12-year old Thorn Schwartz to retain his right to attend school by rejecting a group of motions to dismiss Thorn’s lawsuit challenging a Monroe County school’s withdrawal of his medical exemption from vaccine mandates. And, this is huge, the legal basis for the draconian new rules for medical exemptions imposed by the Cuomo administration last fall were undercut when Judge Doyle made a “preliminary finding that the state has overstepped their boundaries” according to Thorn’s attorney Patricia Finn.

Attorneys for the school and the New York State Department of Health argued that statutory language that allows a physician to issue a medical exemption if, “such immunization may be detrimental to the person’s health or is otherwise medically contraindicated,” actually means, “a child has a medical contraindication or precaution to a specific immunization consistent with ACIP guidance or other nationally recognized evidence-based standard of care.” The Judge rejected the State’s interpretation writing they, “are not entitled to dismissal of the Petitioners’ challenge to the regulation defining “may be detrimental to the child’s health”.

The suit is not over, but Thorn will retain his right to attend school when it resumes while arguments go forward, and this decision provides a preliminary finding that Cuomo’s extreme restrictions on medical exemptions could be ultimately overturned.

Vaccine Choice Protest in Albany, NY

We Need THOUSANDS of People!

February 16, 2020 – We’ve gotten thousands of people in Albany before to fight for our rights to Health Freedom and Vaccine Choice, and we can do it again! When I interviewed the great, brave Assemblyman from New Jersey, Jamel Holley, he was clear as day that only two things can change politics at a State Capitol:

(1) Money, and

(2) Numbers.

It’s hard to ignore thousands of people at a State Capitol. It’s not so hard to ignore hundreds of people. When Holley heard 5,000 (some say 8,000) people in Trenton screaming for their rights to Vaccine Choice it was not hard for him to stand strong and firm with all of us as a Health Freedom Fighter.

After New York lost the Religious Exemption to vaccination, Children’s Health Defense with RFK Jr. and Michael Sussman sued Governor Cuomo and New York State on constitutional grounds. The first day of the lawsuit in Albany 4,000 protesters dressed in white showed up. If we would’ve had those numbers before the Religious Exemption repeal was voted on we would still have the Religious Exemption to vaccination in New York. Do not forget, this issue is bigger than the Religious Exemption; it is bigger than our children; the issue of Health Freedom and Vaccine Choice is going to impact the residents of New York for generations to come. We are fighting for the freedom, health and legacy of untold future generations of New Yorkers.

Vaccine Rights Advocates Rock Albany

Mainstream Media Dead Silent

January 10, 2020 – Over 1,000 people protest vaccine mandates in Albany and the mainstream media (MSM) ignores it. The only mention came from a local CBS affiliate that published a meager 112 words on what was in reality a massive presence. For me it was fantastic to see all of the “King Cuomo” protest signs that match-up wonderfully with my recent reporting on Cuomo.

Also extremely noteworthy, Rita Palma was told by Assemblyman Montesano that his office is receiving as many calls against vaccine mandates as they are against bail reform – that’s huge! Bail reform is the most rejected legislation in New York today. That means New Yorkers overwhelmingly do not support new vaccine mandates; but you wouldn’t know that if you only watch the MSM for your news. What an awesome day in Albany January 8th! Workers at the state buildings said ours was the biggest and LOUDEST group to ever show up for the opening of the Legislative Session. Well over a thousand people showed and Robert F. Kennedy, Jr., warrior mom Brooke Jordan, Rabbi Zev Epstein, Mary Holland co-author of HPV Vaccine of Trial and Assemblymember David DiPietro presented moving speeches to us in the Capitol. One consistent message came from the legislators who are on our side: keep it up!

We began our day in front of Merck’s Albany headquarters, just half a block from the Capitol, for a reason. All the vaccine bills we are fighting in New York are there to make money for Merck, Pfizer, Sanofi & Glaxo, the big four drug companies that sell almost 90% of the vaccines in the world. As US Representative Ilhan Omar said, “It’s all about the Benjamins.”

Merck is a serial felon. They have paid more than $10 billion in fines, penalties and settlements since 2000 including more than $5 billion for at least 60,000 deaths caused by their Vioxx product. And $350 million for bribing public officials and doctors!

Gardasil is the most controversial vaccine in the world. It was banned in Japan for safety reasons. There are lawsuits around the world in those countries that allow lawsuits against vaccine injuries, which does not include the US. It has a horrendous safety record and there is a growing body of evidence that much of the data Merck used to get the product license was fraudulent.

Three of the four bills we are fighting the hardest would give Merck direct access to our kids and shutting parents out completely. They are:

S298b/A2912a, Mandates Merck’s Gardasil to attend school. Think about that, the state is forcing people to buy Merck’s product, which is already a monopoly, and if any child is injured by Gardasil Merck has complete liability protection. Three states have Gardasil mandates, all three allow parents to opt out for any reason, but Not New York’s bill.

S3899a/A973a, Allows giving drugs and vaccines that are marketed as preventing sexually transmitted diseases to minors without parental knowledge or consent. No lower age limits are in the bill.

S4244c/A6564c, Allows any vaccine to be given to children 14 and older without parental knowledge or consent. Any child in school has to have all the mandated vaccines, so this bill is clearly doing two things: targeting homeschooled kids, and promoting Gardasil which is not required to attend school.

S2276/A2316, Mandates annual flu shots for daycare, Pre-K, k-12. This isn’t a Merck specific bill but they sell flu vaccines too.

We need to keep the pressure up. The following people are the key players in the legislature. Please call them and politely ask what their positions are on the bills above and let them know that you oppose all the bills.

It is too late to get a ticket for the speech, but we will be outside exercising out right to peaceably assemble, and to petition the Government for a redress of grievances.
